The process of making an offer to purchase a vehicle is a little more complicated than most people would think. It seems simple enough to walk into the showroom and make an offer to purchase, but there are many legal implications that may arise if any part of this process is deemed conditional. In effect, the concept of conditional acceptance can mean that the purchase of the vehicle is not legally binding.
For example, if you were to go into Kamal Auto TATA and say “I will buy a TATA car if you will give me $10,000 for my Honda”, this is a conditional offer. The terms of your offer will not translate into a legally binding transaction unless conditions are met.
Conditional acceptance can have an impact on whether or not the purchase of a vehicle is valid. If the dealership does not agree to purchase your car off of you prior to you signing your purchase agreement, the purchase will be delayed, or not happen at all.
Conditional acceptance can be applied if the customer is negotiating terms with the dealership. Often times a customer will negotiate terms to see if the dealer can make any accommodations for items like a lower price, or a higher trade-in value so that the customer will not have to pay as much out-of-pocket. When the conditions of the negotiation are agreed upon by both parties, they are written into the contract. It is always a good idea to ensure all elements of the negotiation are accounted for in the contract.
When obtaining conditional acceptance from the sale of a new car, never assume that the deal is done once you have signed your contract. There are multiple scenarios that can occur in which the contract is considered voidable, and therefore no longer effective.
Let’s say you went to Kamal Auto TATA and test drove a Tata car. You loved it so much that you decided to buy it, and the dealer made you a conditional offer of a full tank of gas, and you accepted. However, when it came time to purchase, you noticed there was no fuel in the tank. This scenario has occurred; and affected the finalization of the deal.
Obtaining a conditional acceptance from the dealer can be challenging. Dealers will try to negotiate lower prices for the vehicles, but won’t always agree to all of your terms because the bottom line will be the dealership’s first priority.
It is important to understand when the terms of your purchase agreement have been made unconditional. In the example above, the dealer could have agreed to buy the customer’s car off of them, but in no way were the conditions of the bargain ever fulfilled. The dealership, when it came time to exchange the vehicle for the trade-in, claimed there was a full tank of gas. This would have been an instance where the dealer required more than just a conditional acceptance to finalize the deal, because they would end up losing money on the trade.
